Acceptance of Terms
These Terms of Use (the “Terms”) are a legal agreement between you and PeakMHC and its affiliates (collectively, “Peak Communities,” “we,” “our,” or “us”). These Terms govern your access to and use of our website https://www.peakmhc.com/ (the “Site”) and the Tenant Web Access portal (the “Portal”).
By accessing or using the Site or Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of our digital services.
Changes to this Agreement
Without prior notice to you, PeakMHC may update or otherwise change any Terms at any time in its sole discretion. If you continue to use the Site or any Service thereafter, such continued use of the Site or any Service will constitute acceptance of such updates and changes and an agreement to be bound by the Terms, as thereby amended. If you do not agree to the updates and changes, you agree to discontinue your use of the Site and all Services. You can review the most current version of these Terms at any time on peakmhc.com.
Proprietary Rights and Limited License
All content on the Site, including but not limited to designs, text, graphics, pictures, video, information, software, floor plans, community listings, and other files, and their selection and arrangement (the “Site Content”), are the proprietary property of PeakMHC with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without our prior written permission, except that, if you are eligible for use of the Site, you are granted a limited, revocable, nonexclusive, non-assignable, non-sublicenseable license to access and use the Site and to download or print a copy of any portion of the Site Content solely for your personal, non-commercial use, provided that you keep such portions confidential and all copyright or other proprietary notices intact. You may not republish Site Content on any internet, intranet or extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Any use of the Site or the Site Content other than as specifically authorized herein, without the prior written permission of PeakMHC, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable by us at any time without notice and with or without cause.
No Offer and Forward-Looking Statements
The information on this Site is for informational purposes only and nothing on this Site shall be construed as a binding offer to lease, a contract of sale, or a guarantee of availability. All residential applications are subject to credit approval, criminal background checks, and income verification. Any mentions of upcoming communities, planned amenities, or future developments are projections only and are subject to change without notice. Peak Communities does not guarantee the accuracy of any property descriptions or pricing displayed on the Site, which are subject to change at any time.
Tenant Portal and Electronic Transactions
PeakMHC provides the Portal as a convenience for current residents. You are responsible for all activity occurring under your account and agree to maintain the confidentiality of your credentials. By initiating a payment via the Portal, you authorize Peak Communities or its third-party processor to charge your designated bank account or card. The display of a successful transaction screen does not constitute a waiver of rent or a receipt of cleared funds; if a payment is returned for any reason, late fees and administrative charges will apply as per your Lease Agreement. Acceptance of a partial payment via the Portal does not constitute a waiver of Peak Communities’ right to seek the remaining balance or proceed with legal remedies, including eviction. In the event of a conflict between these Terms and a signed Lease Agreement, the terms of the Lease Agreement shall prevail.
Fair Housing Commitment
PeakMHC is an Equal Housing Opportunity provider. We conduct business in accordance with the Federal Fair Housing Act and applicable state laws. We do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, or any other protected class.
Disclaimer of Warranty and Limitation of Liability
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” USE OF THE SITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PEAKMHC DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE AND IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PEAKMHC OR ANY OF ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF THE SITE, ANY DELAYS or INACCURACIES IN INFORMATION, OR ANY SERVICES OBTAINED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to defend, indemnify, and hold harmless PeakMHC and its officers, directors, employees, and agents from any claims, costs, losses, damages, judgments, and expenses, including without limitation reasonable attorney’s fees, relating to or arising out of any breach of this Agreement or any use of the Site or the Portal by you or by any other person using your credentials.
Governing Law and Arbitration
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas and the Federal Arbitration Act, without giving effect to any principles of conflicts of laws. You and PeakMHC agree that any and all disputes relating in any way to this Agreement shall be submitted to and resolved by means of confidential arbitration conducted in Dallas County, TX under the Commercial Arbitration Rules of the American Arbitration Association. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other current or former user of the Site, whether through class arbitration proceedings or otherwise.
